1. Welcome to SIM Proxy!

On this page, we explain the rules you agree to when using SIM Proxy. These rules are important to follow. While some of them may seem complicated because of the legal language, we have tried to explain them in simple terms, like the summaries you see in these boxes. Remember, these summaries are not part of official legal terms.

By accessing this website (referred to as the "Site") and/or any part of the associated infrastructure (referred to as the "Infrastructure") collectively referred to as the "SIM Proxy" provided by SIA Raga Games and its related companies (including its parents, subsidiaries, affiliates, and their agents, representatives, consultants, employees, officers, and directors collectively referred to as "we," "us," or "our"), you agree to abide by the rules set out in these legally binding terms and conditions (referred to as the "Terms"). You also agree to our Privacy Policy and agree to comply with all local laws applicable to you.

From time to time, we may need to make changes to these Terms. If this happens, we will be sure to inform you of important changes by posting a notice on the Site or sending you an email. These changes will not apply to anything that happened before they were made. We will always let you know the exact start date of the new Terms. If you continue to use SIM Proxy after the changes have been made, this means that you agree to the updated Terms.

2. Account creation

Creating an account using fake or stolen information is prohibited and will result in a KYC check.

You may browse the Site without creating an account. However, you must create an account to purchase our services. You must provide accurate and complete information when registering. The use of invalid or other people's information is prohibited. We may request additional verification (KYC) for suspicious accounts. You will not be able to use purchased services or request a refund until the KYC check is completed to prevent abuse.

If you are not comfortable providing real details or going through the KYC process, please refrain from registering.

To register, you must be at least 18 years old or have the legal capacity to enter into a contract in your jurisdiction.

You are responsible for all activity on your account, and you must keep your password confidential. If you suspect unauthorised use, please contact us immediately.

3. Prohibited activities

In this part, we remind you of what is strictly forbidden: breaking laws, harming others, stealing data, hacking into computers, or disrupting web services. Let's keep it clean and follow the rules. Remember, we are not here to provide anonymity or support illegal activities. If the authorities ask, we will cooperate with them.

We want everyone to behave responsibly and maintain a positive atmosphere. Here are some things to avoid when using SIM Proxy:

• Do not use SIM Proxy for illegal activities. Respect the rights of others and obey the law.
• Do not engage in spamming. Avoid sending unsolicited advertisements, junk mail, or chain letters through SIM Proxy.
• Do not harm other people's computers. Do not distribute viruses or any software that disrupts the normal functioning of software, hardware, or equipment.

We must ensure the security and proper functioning of SIM Proxy. Therefore, avoid actions that may disrupt it or adversely affect other users:

• Do not attempt to interfere with the operation of SIM Proxy.
• Do not seek ways to circumvent our security measures.
• Do not attempt to harm or access any system data or passwords without authorization, whether ours or someone else's.
• Do not overload our system or our partners' systems with excessive use. If you are unsure of what is reasonable, please contact us for clarification.
• Do not use software or devices to automatically collect information from SIM Proxy.
• Do not attempt to understand or copy our code, ideas, or algorithms by disassembling or reverse engineering any part of SIM Proxy.
• Do not use more data on a purchased mobile proxy than necessary. Excessive data usage may cause strain on cell towers and affect our users. We reserve the right to decide what is considered excessive use.

4. Disclaimer

We are not responsible for any damage or loss that occurs while using SIM Proxy. We do not mediate disputes between users or between users and any third party related to SIM Proxy. By using SIM Proxy, you release us from any claim, loss, or demand, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, arising from such disputes. Any content you access through SIM Proxy is provided at your own risk, and you are solely responsible for any damage or loss that may arise from its use.

We will not be liable for any financial loss caused by the unavailability of SIM Proxy. While we endeavour to ensure that it is available and usable, downtime may occasionally occur. In such cases, we will not be liable for any loss (including direct or indirect economic loss) or damage caused by the unavailability of the services you have purchased from us. However, we will compensate for the time during which you were unable to use the services you purchased due to problems on our part by extending your subscription for at least the same period during which the purchased service was unavailable.

5. Subscription

Each of our services is provided on a subscription basis. We provide a one-time 3-day trial and a 30-day subscription. Automatic renewal is not enabled by default.

You must have an active subscription to all of our services that you wish to use. The plan you choose (3-day or 30-day) will not automatically renew after the end of each billing cycle. To continue using the service you purchased, you must either manually renew its subscription or enable automatic renewal.

6. Payments

You can pay for your subscription either by Credit Card or Bank Transfer.

6.1. Automatic renewal by Credit Card

By providing authorization for automatic payment from your Credit Card (a billing agreement), you grant us the authority to collect or reverse fixed or variable charges from your Credit Card on a recurring basis until you cancel your authorization.

If your payment requires currency conversion, the currency conversion fee will be determined by the applicable third party at the time your payment is processed. You acknowledge that the exchange rate at the time of each payment transaction may fluctuate and agree that future pre-approved payments will be based on exchange rate fluctuations.

We will send you an email notification after each automatic payment has been made, but we will not send any notices prior to processing such payments.

6.2. Automatic renewal by Bank Transfer

There is no option to enable automatic subscription renewal by Bank Transfer. We suggest that you extend your subscription for a certain period in advance.

7. Subscription cancellation

By default, a purchased subscription is not automatically renewed.

While we would be sad to see you go, you can simply stop manually renewing your subscription, and it will eventually expire. If you have automatic renewal enabled, you can turn it off, and your subscription will eventually expire.

Once the subscription expires, the purchased service is terminated, and all associated data is deleted from your account.

8. Refunds

You have 48 hours to change your mind on your first order and request a refund. However, be sure to contact our support team to initiate this process. Chargebacks are considered rude and will result in your account being blacklisted.

We will refund your first order if the service purchased does not solve your problem within the first 48 hours of purchase or if we are unable to make it work on your end. This satisfaction guarantee is valid for the first 48 hours after purchase. However, refunds for accounts that require KYC verification will only be issued once the verification process has been successfully completed.

Refunds for automatic renewal payments will be issued upon request within 48 hours of debit. You can make a request by contacting us.

Once the refund is processed, your subscription instantly becomes expired, the purchased service is terminated, and all associated data is deleted from your account. In addition, the invoice associated with your purchase will be cancelled or a credit note will be created. Your account will remain intact.

9. Account deletion

You have the right to delete your account at any time by contacting us.

You have the right to contact us at any time and ask us to delete your account. If there are any ongoing payment obligations between you and us, they must be settled in advance. Even after deleting your account, all of these Terms remain in effect. With the exception of billing and traffic logs, all other data associated with your account will be deleted. We keep traffic logs to assist law enforcement if necessary.

10. KYC verification

To prevent SIM Proxy from being used for disreputable purposes, we may ask you to verify your identity. If we notice anything suspicious, we will require you to confirm your identity in order to continue using the services you have purchased.

We may ask you to verify your identity if we suspect that you have used fake or stolen information to register or make a payment, or if we notice suspicious activity from a service you have purchased.

One example of suspicious activity is the use of a purchased mobile proxy to make Credit Card payments or visit websites where the use of a mobile proxy has no legitimate purpose.

To complete the KYC verification process, you will need to send us a selfie with a legible government-issued ID as well as a photo of the Credit Card used for payment (only the first and last 4 digits should be visible).

If you are not comfortable going through the KYC process, you should not register for or purchase our services. Refunds will not be issued until the KYC verification is successfully completed.

11. Fair use policy

The term "Unlimited Data" is subject to fair use.

While we do not set fixed monthly limits on data usage on mobile proxies, we actively monitor the average data usage on them. If we detect unusually high usage that could jeopardise the SIM card, our positive relationship with the mobile operator(s), cause congestion on cell towers, or our infrastructure, potentially affecting the quality of SIM Proxy for other customers, we reserve the right to refund any remaining unused days in your subscription and delete your account. Rest assured, we will always let you know before taking any such action.

12. Our rights

In order to keep everything running smoothly, we need to control what happens. Therefore, in this section, we reserve the right to make decisions to ensure the health and integrity of SIM Proxy. We do not take this responsibility lightly and will only use it when necessary.

We reserve the following rights:

• We may make changes to SIM Proxy without any notice or liability.
• We have the right to decide who can use SIM Proxy. We may delete accounts or refuse to provide services (especially if they are misused). If you have purchased our services but we believe you are not eligible to use them, we will refund your remaining unused subscription days (unless a KYC check request is open for your account) and delete your account. We may change our eligibility criteria at any time. If any of your activities are prohibited by law in your jurisdiction, you may not use SIM Proxy at all.

We are not responsible for any damage caused by these actions and reserve the right to refrain from commenting on them.

13. Dispute resolution and governing law

We are located in Riga, Latvia, and any disputes with us must be resolved in Riga in accordance with Latvian law.

We recommend that you first contact us if you encounter any problems before considering legal action. If legal action is necessary, these Terms (along with any other applicable rules, policies, or guidelines) will be governed by and interpreted in accordance with the laws of the Republic of Latvia. This agreement excludes the application of the Uniform Computer Information Transactions Act (UCITA) or the United Nations Convention on Contracts for the International Sale of Goods (CISG) and does not confer jurisdiction over us outside the Republic of Latvia. Any legal disputes arising out of these Terms or your use of SIM Proxy shall be brought exclusively in the public courts of Riga, Latvia. By using SIM Proxy, you agree to submit to the jurisdiction of those courts for any such disputes, and you waive any right to trial by jury in such matters.

14. The rest

These Terms set out our official rules and regulations for dealing with SIM Proxy. If you encounter any conflicting or confusing information regarding our policies, these Terms are the final authority. We thank you for taking the time to review them and choosing our services!

These Terms and all materials referenced herein constitute the entire agreement between you and us with respect to SIM Proxy. They supersede all other communications and proposals, whether oral, written, or electronic, and govern our future relationship. If any provision of these Terms is held invalid at law, it will be limited or waived to the minimum extent necessary for the Terms to remain in full force and effect. The failure of either party to exercise any right under these Terms shall not be construed as a waiver of any other rights.

These Terms are personal to you and may not be assigned, transferred, or sublicensed without our prior written consent. We reserve the right to assign, transfer, or delegate any of our rights and obligations under these Terms without your consent. Notice of such actions will be given by email, in writing, or prominently displayed on the Site.

15. Effective date of these Terms

These Terms come into effect on February 24, 2024, at 00.00 Eastern European Time (EET) and apply to all actions taken on SIM Proxy since then.
